Can any agency save the fraud ridden Sarva Haryana Gramin Bank ?

Complaint in CBI against fraudulent loan to Sarva Haryana Gramin Bank.

I humbly submit the laid down defination of fraud pronouced by the Supreme Court of which as as below :

In law, fraud is intentional deception to secure unfair or unlawful gain, or to deprive a victim of a legal right. Fraud can violate civil law (i.e., a fraud victim may sue the fraud perpetrator to avoid the fraud or recover monetary compensation), a criminal law (i.e., a fraud perpetrator may be prosecuted and imprisoned by governmental authorities), or it may cause no loss of money, property or legal right but still be an element of another civil or criminal wrong.[ The purpose of fraud may be monetary gain or other benefits, for example by obtaining a passport, travel document, or driver’s license, or mortgage fraud, where the perpetrator may attempt to qualify for a mortgage by way of false statements.

I also submit you to decide whether the following acts of Shri A.K. Nanda, Chairman, Sarva Haryana Gramin Bank and Dr. M.P. Singh, Ex-Chairman falls in that line or not. It is very strange that still no action against these culprits has been taken by any authority despite my constant pleading with each Agency.Complaint in CBI against fraudulent loan to Sarva Haryana Gramin Bank.

I again submit that a impartial enquiry against these culprits be conducted, I commit to associate myself with every evidances:

The following is act of Fraud on the part of Shri A.K. Nanda which definitely qualified the defination of fraud of Supreme Court of India as enumerated above:

The auditors in their annual report of BO Sector-44, Gurugram reveals (Report attached) that Sh. A K Nanda in collaboration with his accomplice Rajesh Goyal, Former General Manager at SHGB allowed the diversion of crores of rupees. Although I have raised this issue earlier also and requested your esteemed office to order an impartial enquiry but this issue was not enquired till now. Now the auditors reveals that so many violations were made in many house loans in the branch. The contents of the reports speaks itself, I want to highlight the some –

There was no sanction letter in files of 7767NC00981075 and 7767NC00981084. Moreover it is strange that sanction is done on verbal communications in both of the cases whereas the sanction amount of these cases is Rs. 4.17 crore and 4.03 respectively.

How can the interest waiver of 2% can be given without sanction by the competent authority. It is also done on verbal communication.

The proceeds from these accounts were transferred to the firm namely M/s 4S Developers Pvt Ltd whose Directors are the borrowers themselves.

I further want to bring to your notice that these borrowers (Four loan amounting Rs. 6.58 Cr to the members of same family vide accounts nos. 7614NC00989746,64,73 and NC-989816) were also financed from Badshahpur branch located in the same district under House Loan category whereas the family has made a firm M/s 4S Developers Pvt Ltd whose directors are the family members themselves. They are doing business of Sale-Purchase of the flats constructed by themselves. Extending benefit to such firms can be understood easily.

The auditors mentioned clearly that this is the case of diversion of funds. But central auditors didn’t mention this fraud activity in their report which seems that the central auditors have been gratified. Otherwise how it can be possible that despite not being in the list of auditors, the same firm is being listed as central auditors consecutively second year. The funds of crores of rupees have been diversed and no action has been taken so far indicstes that these corrupt officials have string nexus at PNB head office level too.

Act of protecing fraud elements of the part of Dr. M.P. Singh, Ex-Chairman and Shri A.K. Nanda, Chairman:
Establish fraud:
The undersigned lodged a complaint regarding of undue benefits extended to Smt. Bimla and others in a bogus 10 crore Housing Building Loan. In routine, the comments of erring official i.e. Dr. M P Singh, Former chairman, Sarva Haryana Gramin Bank were sought as well as that of present incumbent Sh. A K Nanda in routine. Both Dr. M P Singh and Sh. A K Nanda in collusion with each other misled the higher authorities at PNB submitting false and misleading facts and tried their best to get the complaint dropped. But I was also bent upon to bring the truth at surface as the bank would have suffered a loss more than 3 crore rupees only in this single case. (ROI in Loan against immoveable property is 10.50% whereas in House Building Loan it was 8.55 % at the time of sanction of this loan, which was brought down to 8.05% later on). And if I compare the loss in comparison to the rate of interest being charged by the NBFC the benefit (Undue) would be much more than the benefit shown above as the NBFC was charging interests @ 24% after the expiry of one year.

On my persistent follow up, PNB ordered an investigation in this matter and Sh. Ajay Kapoor, AGM investigated the case threadbare. (The report of which annexed along with). Mere perusal of the findings of the report (Given at second last page of the report) would reveal that the guidelines of the bank have been violated at so many points ignoring the adverse observations made in the process note sent by concerned Regional Office. With regards to bribe allegations, the report says “no such facts have come to notice”. I want to clarify that if there were any eyewitness or pictorial evidence of the incidence of taking bribe, the concerned official would have been booked under the provisions of the Indian Penal Code. Sir, it is further added that whether any officer resort to making many violations without any ulterior motive ? Whether such a huge undue benefit be extended without mala fide intentions ? Obviously they tried to mislead the authorities at PNB.
This is a million dollar question and sir the obvious answer is — it is someone at PNB who protected them for their every wrong doing. The official at PNB is the main link in this unholy nexus who provided safe passage to them every time otherwise it is impossible that no action was taken even when the inquiry officer deputed by PNB has clearly mentioned that the gross and deliberate violations were committed by these officials.
Shri S D Puri, Chief Manager who committed fraud (RBI Reported) amounting to Rs. 1.45 crore and the total amount was shown less than the actual amount to avoid referring the matter to CBI. Sh. S D Puri was not suspended despite having spent many days (approximately four and half months) in jail in a fraud case of multiple crores at Neoli Kalan branch in Hisar district. He was allowed to join at Head Office and most important department i.e. inspection department was given to him. In his case, Sh. A K Nanda reported a case of fraud of Rs. 1.45 Crores mischievously whereas the total amount is around 4 crores. This is done to save the case from CBI investigation.

Shri H.C. Saini committed fraud (RBI reported) amounting to Rs. 1 crore in BO Rania. He was neither suspended and after awarding light punishment he was made Head of CAD Division at Head Office. No amount recovered so far. Bank has to waive the entire amount.

Shri M.P. Chapola, Chief Manager committed fraud (RBI Repoted) in BO Karnal amounting to Rs. 4.50 crore. He was suspended and reinstated and made the Head of Inspection and Audit Division which is looking fraud cases.

Our allegations proved true in 10 Crore HBL case of Smt. Bimla Devi :- when we followed the fraud sanction of Rs. 10 crore persistently, the matter was investigated by Sh. Ajay Kapoor who also called us and we brought to his notice the whole scene. Later on Mr. kapoor reported that there were flagrant violations of the laid down guidelines. The action on his report is awaited at PNB level.

The working of the above officers is dangerous for the lower staff and is inculctating the habit of fraud amount lower staff and fraud in the bank are increasing day by day.
